These Terms of Service (“Terms”) govern your access to and use of the website, products and services provided by Digital Toolbox GmbH (“Digital Toolbox”, “we”, “us”), including ToolboxVR and GuidedGenius (together, the “Services”). By accessing or using the Services, you agree to these Terms.
01Acceptance of terms
By accessing or using the Services, or by entering into an order or engagement with us, you agree to be bound by these Terms. If you use the Services on behalf of an organisation, you confirm that you are authorised to bind that organisation.
02Definitions
- “Services” — the digitaltoolbox.gmbh website, ToolboxVR, GuidedGenius, and any related consulting or production services.
- “ToolboxVR” — our immersive, device-agnostic 3D platform.
- “GuidedGenius” — our AI-supported learning platform.
- “Content” — data, materials and inputs you provide or generate through the Services.
03Eligibility and accounts
You must be able to form a binding contract to use the Services. You are responsible for keeping account credentials secure and for all activity under your account. Notify us promptly of any unauthorised use.
04Acceptable use
You agree not to misuse the Services. In particular, you will not:
- reverse engineer, resell or provide unauthorised access to the Services;
- upload unlawful, infringing or harmful content;
- interfere with the security or integrity of the Services;
- use the Services to violate any applicable law or third-party right.
05ToolboxVR — product terms
ToolboxVR delivers immersive experiences across desktops, tablets, phones and headsets; a headset is optional. Availability of specific features may depend on your device and configuration. You are responsible for a safe physical environment when using immersive hardware.
06GuidedGenius — product terms
GuidedGenius provides AI-generated learning guidance intended to support understanding. It does not guarantee specific learning outcomes and is not a substitute for professional, medical, legal or financial advice. You are responsible for reviewing outputs before relying on them.
07Intellectual property
The Services, including software, platforms, designs and trademarks (Digital Toolbox, ToolboxVR, GuidedGenius), are owned by Digital Toolbox or its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Services as intended; no other rights are granted.
08Your content
You retain ownership of Content you provide. You grant us the rights needed to host, process and deliver the Services, and, for GuidedGenius, to generate responses to your inputs. You are responsible for ensuring you have the rights to the Content you submit.
09Engagements and fees
Custom projects, consulting and production work are governed by the specific order, proposal or statement of work agreed with you, which forms part of these Terms. Fees, scope and timelines are set out there. Unless stated otherwise, fees are exclusive of applicable taxes.
10Third-party services
The Services may integrate or link to third-party services. We are not responsible for third-party content or practices, and your use of them is governed by their own terms.
11Disclaimers
The Services are provided “as is” and “as available”. To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted or error-free.
12Limitation of liability
To the extent permitted by law, Digital Toolbox is not liable for indirect, incidental or consequential damages, or for loss of data, profits or revenue. Nothing in these Terms limits liability that cannot be excluded under mandatory law, including for intent, gross negligence, or injury to life, body or health.
13Indemnification
You agree to indemnify Digital Toolbox against third-party claims arising from your unlawful use of the Services or your Content, to the extent attributable to you.
14Term and termination
We may suspend or terminate access if you materially breach these Terms. You may stop using the Services at any time. Provisions that by their nature should survive termination will do so.
15Deleting your account and data
You may delete your account and its data at any time, directly within each product. Deletion is subject to any records we are required to keep by law, as described in our Privacy Policy.

ToolboxVR — App (Windows standalone, macOS, Meta Quest / Oculus, Pico)
- 1Sign in to the ToolboxVR app.
- 2Open your profile using the person icon at the top right.
- 3Under “Save Profile”, select “Delete My Data”.
GuidedGenius
- 1Sign in to GuidedGenius.
- 2Go to Account settings.
- 3Select “Delete My Account”.
16Governing law
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction, where legally permissible, is the registered seat of Digital Toolbox GmbH.
17Changes to these terms
We may update these Terms to reflect changes to the Services or legal requirements. Material changes will be communicated where appropriate; continued use after changes means you accept the updated Terms.
